These terms and conditions are applicable to every offer of Maison Muses. The terms and conditions are available for everyone on the website www.maisonmuses.com.

Article 2 – Scope of application
2.1These general terms and conditions apply to all purchase and sales agreements entered into by visitors to our website. Whenever you place an order with us, this means you agree with these Conditions. These general terms and conditions apply only to the physical person that, exclusively for non-professional purposes, uses or acquires products or services that were brought on the webshop.
2.2 In order for the customer to place an order, he/she must be at least 18 years old. If he or she isn’t 18 years old, we kindly ask you to let your parents or legal guarding place the order. If we notice that an order has been placed by a minor, we have the right to reject this order.
2.3 If a customer places an order, this means that he or she explicitly agrees to abide by these conditions, including all statements and components. The customer has been able to read and print these general terms and conditions.
Article 3 – Offer
3.1 The Maison Muses offers have a limited duration. This duration is clearly mentioned on the website.
3.2 Maison Muses has done all in its power to ensure that all the product information, colours, details and descriptions of the items are as accurate as possible. However, please note that images and colour quality may vary depending on the screen on which they are viewed. The Vendor cannot guarantee that a screen is able to reproduce all features of the actual product correctly. Each product is accompanied by a product description (colour, size, type of product, etc.) and digital photographs. Whenever a mistake has been made by Maison Muses, the vendor is not obliged to offer the product.
3.3 The prices stated on the website apply to each individual product and include 21% VAT. Prices however do not include postage and packaging charges. The prices stated are valid on the date on which they were posted on the website and on the date on which an order is placed. These prices may be subject to change during the course of the season. If items are priced down or any discount applies to the items after an order is placed, the customer cannot claim any repayment of the relevant price difference or terminate the relevant sales transaction. Maison Muses is not responsible for any form of customs duty or other taxes that may apply after the items are dispatched.
3.4 The stock specified on the website is indicative, and the mere statement of the stock available cannot give rise to any rights and obligations for Maison Muses, which always does all in its power to ensure that the available stock is correctly specified on the website. In the unlikely event that the item ordered is no longer in stock, Maison Muses will immediately notify the customer of this, and the sales and purchase agreement will be terminated free of charge due to the relevant item being unavailable.
3.5 The order is complete and the agreement between Maison Muses and the customer is definitive as soon as the customer receives a confirmation notice from Maison Muses and Maison Muses receives an acceptance notice from the card issuer. When the publisher of the card refuses to agree with the payment to us, Maison Muses cannot be held responsible for any delays with the delivery and/or no-delivery of your order. Orders without a valid payment of the registered card holder cannot by accepted or processed.
Article 4 – Payment
4.1. Maison Muses accepts these payment methods: Bancontact / Mister Cash, KBC / CBC Payment, Belfius Direct Net, Bank Transfer, Creditcard, PayPay, SOFORT Banking and iDEAL. The customer will receive a confirmation of his order on his screen and by e-mail as soon as payment has been effected.
Article 5 – Delivery
5.1 All goods and services are delivered on the address provided by the customer when ordering. Maison Muses cannot be held responsible in any way by mistakes made by the customer while submitting the delivery or billing address and the consequence of a delay of the delivery or the impossibility to deliver the ordered products.
5.2 Items ordered will be dispatched Mondays to Fridays, with the exception of statutory national holidays.
5.2 Orders will be delivered as soon as possible. The delivery time is mentioned on the product page. Maison Muses will do its best to deliver within the indicated delivery time. However, Maison Muses depends on the production process of the designer and since the item is manufactured by him or her, these delivery times are an indication. If a good is delayed, Maison Muses will inform the customer of the new delivery period.
5.3 When a product is out of stock, the customer will be notified via e-mail about a later delivery date. When the customer does not agree with the delay, the ordered product can be cancelled or the customer can order an alternative product. The cancelld product will be refunded or, when ordering an alternative product, the remaining amount or the amount due will be refunded or billed.
5.4 The shipment of goods is always at Maison Muses’ risk. When the goods, delivered by Maison Muses, were damaged during the transportation or do not correspond with the ordered items, the customer is obliged to notify Maison Muses within 3 days and to return the items within 14 days after reception.
5.5 If the customer returns a product within 14 days after the purchase, because he or she doesn’t want to keep the purchased item, the customer is responsible for the transportation.
5.6 Whenever a customer isn’t at home during the delivery, we will arrange a new option for delivery. Should the customer fail to arrange for redelivery within three weeks, or should they be out when that redelivery is made, the order will be returned to Maison Muses automatically, who will then contact the customer to arrange for the order to be delivered, in which case the customer may be asked to pay additional delivery costs.
Article 6 – Right of return
6.1 The customer has the right to return the delivered product(s) or part of the delivered product(s) within 14 days without giving any reason. Returning the delivered product(s) is at the expense and risk of the customer. Maison Muses will make sure to pay the total invoiced amount (excluded shipping costs) to the customer within 14 working days.
6.2 Maison Muses is authorized to wait with the refund until it has received the goods back.
6.3 During the first 14 days after delivery Maison Muses kindly asks you to handle the products and packaging with care. All items returned must be unused, unworn, unwashed and in completely undamaged condition. Items must be returned in the original packaging and be in new condition. If the product(s) has been damaged in any way by the customer, the right to return the product(s) expires.
Article 7 – Force majeure
7.1 In case of force majeure, Maison Muses reserves the right to postpone its obligations and also has the right to cancel the agreement partially or entirely or modify the content of the agreement to make it possible to execute. In no case will Maison Muses be obliged to pay a fine or compensation.
7.2 Events of force majeure are all circumstances external to Maison Muses’ will and control that render the respect of our obligations completely or partly impossible. Such events include amongst others strikes, fire, disruption of energy supplies or telecommunication networks or communication systems and/or the temporary down-time of the webshop, late delivery or absence of delivery by suppliers or other third parties, illness of employees and shortcomings in means of transport, …
Article 8 – Intellectual property
8.1 Our website, logos, texts, pictures, names and in general all our communication are protected by the rights of intellectual property that are with us, our suppliers or other persons entitled.
8.2 It is forbidden to use and/or change any of the intellectual property rights as described in the present clause. So you may not copy nor reproduce for example drawings, photographs names, texts, logos, colour combinations, etc. …without our prior written and explicit consent.
Article 9 – Privacy statement
9.1 Maison Muses considers your privacy to be of the utmost importance. Although most of the information on this site is freely available without visitors being obliged to provide any personal data, it is nevertheless possible that users may be asked to give personal information. Such information will exclusively be used in connection with this webshop, e.g. for customer relationship management or for keeping you informed of our events, offers, etc.
9.2 Visitors may always lodge an objection – on request and free of charge – to the use of their personal data for direct marketing purposes. If a visitor wishes to lodge such an objection, he must contact Maison Muses – Sint-Katelijnestraat 36 – 2800 Mechelen (Belgium) or send an e-mail to firstname.lastname@example.org.
9.3 Your personal data will never be passed on to any third parties. However, if this happens, Maison Muses will state the name of such third parties here.
9.4 Under the Personal Data Processing Act (8 December 1992), all users are legally entitled to peruse their personal data and correct this data if necessary. You must also provide proof of your identity together with your request (a copy of your ID card). If necessary, you may also ask to have any incorrect, incomplete or irrelevant data rectified.
9.5 Maison Muses may compile anonymous or aggregate data of a non-personal nature, such as browser types or IP addresses, the operating program you use, or the domain name of the website through which you arrive at our website or through which you leave it. This enables us to optimize our website continually for our visitors.
Article 10 – Complaints procedure and contact
10.1 Our main priority is that our customers are 100% satisfied. If you would have any complaints about our services, you can contact us via firstname.lastname@example.org We will take your complaint into account within 7 days.
10.2 On all agreements we close up with our customers, regardless their living place, the Belgian law is applicable and only the Belgium courts are authorized with disputes.
